Scope of Application

This document (general terms and conditions of sale)applies to all legal acts concluded between the "Customer", the person making a purchase on the online store www.lora-moi.ch and "Lora&Moi", the company owning the site.

Lora&Moi reserves the right to make changes to the General Terms and Conditions of Sale (hereinafter "T&C") at any time. The version of the GSC in effect on the day of the validation of the order is decisive and any other versions will not be applicable for this order. Provisions of the Customer, which are in disagreement with/or contradictory to these GTC are not recognized.

The offer of products and services of the online store (hereinafter "offer") is intended for all customers domiciled in Switzerland and Liechtenstein or abroad.

Products and prices

Product images that appear in the online store, in catalogs, in advertising, on social networks, etc. serve as representations and are non-binding.

Lora&Moi reserves the right to change its prices at any time according to market and/or price developments. The prices are net in Swiss francs, including VAT. The contribution to the processing and shipping costs, which varies according to the characteristics of the order is indicated separately in the shopping cart and on the invoice.

The price displayed in the online store at the time of ordering is decisive.

Orders

All orders can be placed on the website or by phone Monday through Friday from 8:00 am to 12:00 pm and 13:30 pm to 18:30 pm. Internet access and telephone charges are at the expense of the Customer.

Any purchase is confirmed by the Customer by means of a "double click", which constitutes an irrevocable consent that can only be questioned within the limits provided in the GTC. After the validation of his order on www.lora-moi.ch, the Customer will receive a confirmation of the order by email which will be considered as proof. Any order implies prior consideration and full approval of the T&Cs.

If any additional costs or fees should apply, the Customer will be informed by email or by Lora&Moi's Customer Service. A new invoice will then be issued if necessary.

The offer and prices are valid as long as they are visible on the site, as long as they can be found using the search function and/or within the limits of available stocks. The Customer will be informed as soon as possible in the event that an ordered item is unavailable for reasons beyond Lora&Moi's control. The order of the unavailable item will be automatically cancelled and no bank debit will be taken. Lora&Moi reserves the right to offer the Customer a replacement product of equivalent quality and price.

The company Lora&Moi reserves the right to refuse or cancel any order from a Customer following a dispute concerning a prior payment or if it considers that the Customer represents a risk.

Promotional Offers

The conditions relating to Lora&Moi's offers (period of validity, products concerned and the offer) are specified on each promotion.

A voucher offered as a discount or gift can only be used once and for a single order.

Lora&Moi offers cannot be combined with other promotional offers.

Offers or promotions do not include services such as engraving, repairs, overhauls, etc.

The offers proposed by Lora&Moi are valid within the limits of available stocks and are in no case refundable in cash.

If the Customer is in possession of a promotion code, he/she must indicate it in the field provided for this purpose in the shopping cart (order summary), below the list of products ordered in order to benefit from it.

When the Customer with a promotional coupon makes a partial return of their order, the conditions of application of the promotional offer may change and render the promotional code null and void.

Shipping Times and Transportation

Lora&Moi places great value on displaying availability and shipping times as current and accurate as possible on the online store. However, all availability and shipping time information is provided as an indication and may be changed at any time due to production and/or delivery problems that would cause delays.

Shipping times for each product are indicated as an indication on each of our product sheets as follows:

  1. Shipped within 1-3 business day(s), product in stock in our warehouse will be shipped within 1-3 business day(s)
  2. Shipped within 2-5 business day(s), product in stock at our supplier will be shipped within 2-5 days
  3. Shipped within 1-2 business week(s), product in stock at our supplier will ship within 1-2 business week(s)
  4. Shipped within 4-6 business week(s), product in production will ship within 4-6 business week(s)
  5. Out of stock, product is no longer available for sale

Shipping times listed are in business days. When several products are ordered and their shipping date differs, the shipping date to be taken into account is the one reported as the furthest, subject to the possibility, for Lora&Moi, to make partial deliveries. In this case, the contribution to the processing and shipping costs will be charged for a single shipment. The products are shipped to the delivery address indicated by the Customer at the time and in the context of his order. No delivery will be made to hotels. The delivery address may be in Switzerland, Liechtenstein and foreign countries for which we allow orders.

If the Customer's order is placed before 1:00 p.m. and provided that all items are in stock, it will be transmitted to the Swiss Post Office on the same day.

Orders placed after 1:00 pm will be transmitted to Swiss Post within 2 business days.

Geographic delivery areas and rates

The shipping and distribution partner for Lora&Moi orders is Swiss Post.

Postage is generally charged but depending on the period or promotions on our store, it may be offered. This free shipping is only available for Switzerland and Liechtenstein.

Lora&Moi mainly ships to Switzerland and Liechtenstein. However, orders are also allowed for some foreign countries. The list of countries for which Lora&moi allows orders can be viewed during the checkout process at the customer or guest

account creation step.

The delivery time indicated in the table above is the time it takes to receive the package after it is handed over to our delivery partner.

For foreign countries and depending on the place of shipment, the postage and packaging costs differ according to the geographical area to which each country belongs.

The delivery times shown in the table above are the time it takes to receive the package after it is handed over to our delivery partner.

Customs taxes:

The possible expenses and customs taxes, which differ according to the country (except delivery in Switzerland and Liechtenstein), are the responsibility of the Customer and are at his expense, in addition to the amount of his order and the costs of postage and packaging. Depending on the law in force in the country of destination of the order, customs taxes may be duly claimed from the recipient of the package. It is therefore the responsibility of the Customer to check with the competent authorities of his country or the country of the recipient of the order.

Shipment tracking

When ordering on the website www.lora-moi.ch the Customer has the possibility to follow the routing of his order thanks to the "Track and Trace" number, sent by email in the shipping confirmation.

The delivery times of the shipments are for information only, as we cannot guarantee them. They are the responsibility of the Swiss Post and can be viewed at any time on the Swiss Post.

Extended shipping time

The delivery time is extended in the following cases:

  • First order from a new Customer;
  • Engraving;
  • Out of stock.

Possible delays in delivery

In the event of a delay in delivery on the part of Lora&Moi, an informational email will be sent to the Customer and a new date will be proposed. The Customer is entitled (except for special orders) to terminate the contract from the 30th calendar day following the previously announced delivery date. Lora&Moi undertakes to reimburse the Customer the amount already paid. There is no possibility of complaints to Lora&Moi.

Non-return or non-receipt of the shipment

If the ordered products are not received by the Customer on the agreed delivery date, Lora&Moi grants itself the right to terminate the contract and to charge the Customer the delivery costs incurred, as well as compensation up to 25% of the total amount of the order, minimum CHF 60.-.

Conclusion of contract

The products and prices found in the online store are to be considered as offers. However, these offers are always subject to impossibility of delivery or incorrect price indication. The contract is concluded as soon as the Customer completes the order in the online store, by telephone, e-mail or fax.

If an order is placed online, the receipt of the order is confirmed to the Customer by means of an automatically generated order confirmation by e-mail. It is not confirmed in the automatically received e-mail order confirmation that the product can actually be delivered. This confirmation simply communicates to the Customer that his order has been received by the online store and that the contract has therefore been concluded subject to the condition that all products can be delivered and that the prices indicated are correct.

Payment

Payment Methods

Lora&Moi accepts the following payment methods:

  • E-banking (pre-payments by bank and postal transfer);
  • Visa and Mastercard credit cards;
  • PayPal;
  • PostFinance;
  • Postcards debit cards;
  • Twint;
  • Bitcoin;

All fees related to payment methods can be viewed under our "payment terms". They are also indicated in detail in the ordering process.

For credit card payments, the charge is made during the order process.

If the Customer chooses the pre-payment method, delivery will only be made once the full amount is received. From then on, the ordered products that are in stock are reserved for the Customer until the expiry of the payment term which is 1 month. However, products that are to be delivered by an external distributor will only be ordered after the payment is received.

Customer's verification duty

Any reservations about the condition of the products (e.g. open or damaged package) must be immediately announced at the time of delivery to the carrier.

It is the Customer's responsibility to check the delivered products for accuracy, functionality and completeness. If the received product shows defects or possible errors or damages, it is the Customer's responsibility to announce it to Lora&Moi immediately after their discovery but at the latest within 5 calendar days after receipt of the package, the postmark being proof. After this period, only hidden defects may still be claimed. They must be notified to Lora&Moi in writing within 5 calendar days after their discovery.

The Customer must keep the package in a safe place.

The Customer must keep the defective product as received, in its original packaging and is not allowed to use it.

Warranty

All products on the Lora&Moi website have a 2-year warranty, which includes freedom from defects and proper functioning of the products.

Lora&Moi can apply the warranty benefit in the following ways:

  • Free repair;
  • Partial or total replacement with a product of the same value;
  • A credit note at the price of the day, at most the selling price at the time of the order.

Other provisions apply for products designated as "display item", "demonstration item", "repair", "recycled", "test product" on the website. These are not new items and may have apparent defects or be refurbished products. This is the reason why they are sold at a reduced price. These apparent defects are not included in the guarantee and are mentioned on the product sheet of the articles. The warranty period for these products is 1 year.

Warranty exclusion

The warranty does not cover normal wear and tear of the products (scratches, deformations, loss of crystals due to dropping, shocks on the product or misuse of the product).

Periodic revisions, batteries, glasses and watch bands are not included in the warranty and are the responsibility of the Customer.

Out-of-warranty repair

Any out-of-warranty repair costs are the responsibility of the Customer.

Return Policy

Return of products delivered without defect

Lora&Moi grants a right to return ordered products within a maximum of 14 calendar days after receipt of the items.

If the Customer wants to return items that he or she does not want, he or she will have to bear the entire cost and risk of returning the products, unless the error is attributable to Lora&Moi. In this case, the shipping costs are reimbursed to the Customer in the form of postage stamps. Products must be returned by registered mail to the address indicated under the "Contact" section of the www.lora-moi.ch website. Returned items must not contain any traces of wear and tear, otherwise they will be charged in full to the Customer. In addition, they must be returned in their original packaging (including case and instructions). In the event that any accessory delivered with the product (case, instructions, etc.) is missing, it will be charged CHF 10.- each.

Exclusion of return

Lora&Me does not take back the following items:

  • Engravings;
  • Customized products;
  • Unique pieces;
  • Etc.

According to the Customer's desire, Lora&Moi undertakes to refund the items already paid by crediting them to the customer's account,by transfer to the bank, postal, PayPal account, etc. or to exchange them for equivalent items.

Unidentifiable returns

Any product return must be accompanied by a copy of the invoice or delivery note referring to it. Returns for which we do not have information will be stored for a period of 3 months. After this period, they will be destroyed.

Data Protection

In order to ensure a better use of our online store, we collect your personal data (duration of visit, pages viewed, etc.), by means of cookies, according to the current Swiss federal law on data protection.

This data collection is for informational purposes for statistical purposes and is not disclosed to third parties under any circumstances. The information collected is used solely to improve the relationship between Lora&Moi and the Customer on the website.

The data collected is used for statistical purposes only.

The collection of personal data is carried out when:

  • you create a new account at Lora&Moi;
  • you subscribe to our Newsletter;
  • you get in touch with our customer service department;
  • you browse our site;
  • you interact with the plugins of our social networks;
  • etc.

All legal relationships between Lora&Moi and the Customer are subject to Swiss law.

The place of jurisdiction is the Canton of Jura, where the registered office of Lora&Moi is established.
